Terms of Service

Legal Agreement for GotAppt Notification Services

IMPORTANT DISCLOSURE

GotAppt operates as an independent third-party notification service and maintains no official affiliation, partnership, endorsement, or authorization from the Texas Department of Public Safety (DPS), Department of Motor Vehicles (DMV), or any other government agency.

DEFINITIONS

“Access Period” means the fixed-duration service access selected by the user at the time of purchase (e.g., 3-day or 10-day access).

“Notification” means an automated SMS or email alert indicating detected appointment availability at the time of system scanning.

1. SCOPE OF SERVICES

1.1 Services Provided

GotAppt provides automated notification services that monitor publicly available appointment scheduling systems and alert users when appointment openings become available.

  • Real-time monitoring of appointment availability
  • Email and SMS notifications when slots become available
  • Automated scanning of official government websites

1.2 Services NOT Provided

GotAppt does not and will not:

  • Book, reserve, or schedule appointments on behalf of users
  • Confirm, modify, or cancel existing appointments
  • Guarantee appointment availability at the time of user access
  • Provide direct access to government scheduling systems

2. USER RESPONSIBILITIES AND OBLIGATIONS

2.1 Primary Responsibility

Users acknowledge and agree that they are solely responsible for accessing official government websites and completing appointment bookings after receiving notifications from GotAppt.

2.2 User Compliance

Users must comply with all applicable laws, regulations, and terms of service of third-party government websites when booking appointments.

2.3 Account Management

Users are responsible for maintaining accurate contact information and managing notification preferences through their GotAppt account.

3. PAYMENT TERMS AND SERVICE ACCESS

3.1 Payment Requirement

All service fees must be paid in full prior to activation. No services will be provided until payment is successfully processed.

3.2 Payment Processing

Payments are processed through certified third-party payment processors, including but not limited to Stripe and PayPal. GotAppt does not store or process payment card information directly.

3.3 Access-Based Service Model

GotAppt services are provided on a fixed-duration access basis and are not recurring subscriptions unless explicitly stated at the time of purchase.

  • Each access period begins immediately upon payment processing.
  • Access expires automatically at the end of the selected duration.
  • No automatic renewals apply unless clearly disclosed prior to purchase.

3.4 Service Fulfillment

The service is considered rendered once monitoring is activated and at least one notification is sent to the user during the access period, regardless of whether the user successfully books an appointment.

4. SERVICE LIMITATIONS AND DISCLAIMERS

4.1 No Availability Guarantee

GotAppt makes no representations or warranties regarding the availability of appointments at the time users access third-party booking systems. Appointment availability is subject to real-time changes beyond our control.

4.2 Service Accuracy

While GotAppt strives to provide timely and accurate notifications, we do not guarantee the accuracy, completeness, or timeliness of appointment availability information.

4.3 Third-Party Dependencies

GotAppt services rely on third-party government websites and systems. We are not responsible for changes, downtime, delays, access restrictions, or modifications made by these external systems.

4.4 Real-Time Availability Notice

Appointment availability is highly dynamic and may change within seconds. Notifications reflect availability at the time of detection only and do not guarantee continued availability upon user access.

5. LIMITATION OF LIABILITY

5.1 Liability Cap

To the maximum extent permitted by law, GotAppt’s total liability for any claim arising from or related to these Terms shall not exceed the amount paid by the user for services during the twelve (12) months preceding the claim.

5.2 Exclusion of Damages

GotAppt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption.

6. INDEMNIFICATION

6.1 User Indemnification

Users agree to defend, indemnify, and hold harmless GotAppt, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from use of the service, violation of these Terms, or violation of any third-party rights or laws.

6.2 Defense Rights

GotAppt reserves the right to assume exclusive defense and control of any matter subject to indemnification. Users agree to cooperate fully with such defense.
